The agreement governing your use of Flexweg.
These Terms of Service ("Terms") govern access to and use of the Flexweg platform ("the Service"), a SaaS (Software as a Service) solution for hosting static websites and managing their content through a web interface, a REST API, or the Model Context Protocol (MCP).
Flexweg reserves the right to update these Terms at any time. Changes take effect as soon as they are published on the site. By continuing to use the Service after the changes are published, the User accepts the new terms. The User is encouraged to consult this page regularly to stay informed of any changes.
These Terms form a contract between you and Flexweg. By using our services, you accept these Terms.
These Terms constitute the entire agreement between the User and Flexweg regarding use of the Service. They supersede any prior or contemporaneous agreement, written or oral.
Flexweg is a static-site and HTML-page hosting platform, operated by Weggs (a French SARL registered with the Montpellier Trade Register under SIREN 810 316 679).

You must be at least 18 years old to use Flexweg.
Any user may publish an HTML page without creating an account. Doing so generates a public URL that remains valid for 24 hours, after which the content is automatically deleted. Flexweg cannot be held liable in case of unavailability or automatic deletion of such content.
To access our services, you need to create an account and provide certain information (such as your email address). By accepting these Terms, you agree to provide accurate, current and complete information, and authorise us to use it to contact you about our services.
You also agree to notify us of any change in the information you have provided.
You agree not to share your credentials with third parties. You are responsible for any use made of our services through your account. If you become aware of any unauthorised use of your account, you must notify us as soon as possible through the contact form at the following address: /contact/.
Personal data provided at account creation is processed in accordance with applicable regulation (GDPR).
Two categories of plans are available: a free account (full site creation with limitations) and paid accounts (extended features and additional storage). Full details are available on the Pricing page.
The User may request deletion of their account at any time from the "Danger Zone" of the Settings page, or by contacting us through the contact form. Deletion permanently terminates access to the Service and removes all hosted content.
Flexweg reserves the right, at any time and without prior notice, to remove or make inaccessible any Content deemed illegal, harmful or contrary to these Terms. Flexweg may also suspend or permanently close the account of any User who violates these Terms. In case of serious legal violation, Flexweg may share account-related information with the competent authorities in response to a legal request.
By using Flexweg you must comply with all applicable laws and with these Terms.
You may not use our services to develop models that compete with Flexweg. You may not reverse-engineer, extract or replicate the components of the Services, including underlying data and models.
You may not use our Services for any illegal, harmful or abusive activity.
You may submit inputs to the services ("Input Data") and receive service outputs based on those inputs ("Output Data"). The term "Content" refers to both Input Data and Output Data.
You are responsible for the Content, including ensuring that it does not infringe any applicable law or these Terms. You represent and warrant that you hold all rights, licences and authorisations needed to provide Input Data to our Services.
You retain ownership of your Input Data and own the Output Data. We hereby assign to you all of our rights, title and interest, if any, in the Output Data.
Due to the nature of artificial intelligence, Output Data may not be unique and other users may receive similar Output Data from our Services. The assignment above does not extend to Output Data of other users or third-party Output Data.
We may use Content to provide, maintain, develop and improve our Services, comply with applicable law, enforce our terms and policies and ensure the security of our Services.
We own all rights, title and interest in the Services.
All elements composing the platform, including software, source and object code, architecture, databases, interfaces, features, designs, and any content developed by the company, are protected by intellectual property law and remain the exclusive property of the company or its partners.
No intellectual property right is transferred to the user under these Terms.
The company grants the user a personal, non-exclusive, non-assignable and non-transferable right to access and use the platform, strictly limited to the duration of their subscription and solely for the purpose of using the service as intended.

Any unauthorised use constitutes counterfeiting that may engage the civil and criminal liability of its author.
The user remains the sole owner of the content they publish via the platform (text, images, video, etc.), subject to the rights necessarily granted to the company to perform the service.
The company reserves the right to take any action necessary to put an end to any infringement of its intellectual property rights.
If you subscribe to a paid plan, you must provide complete and accurate billing information, including a valid payment method. For paid subscriptions, we automatically charge your payment method on each agreed renewal period until you cancel.
The User may cancel their subscription at any time. No pro-rata refund is granted for unused periods.
We may change our prices from time to time. If we increase the price of our subscriptions, we will inform you at least 30 days in advance, and any price increase will take effect on your next renewal, allowing you to cancel your subscription if you do not agree with the increase.
The company uses all reasonable means to ensure the proper operation and availability of the platform. However, it is held to an obligation of means and not of result.

The company cannot be held liable for indirect damages suffered by the user, including any loss of revenue, customers, data, brand damage or any other commercial loss.
The company makes no guarantee in terms of visibility, search ranking, traffic or commercial performance.
The user acknowledges using the platform under their sole responsibility for their professional activities; the company cannot be held liable for the economic consequences of using the service.
Flexweg does not guarantee the backup or recovery of Content. The User is entirely responsible for keeping their own backups of their content. Flexweg cannot be held liable for any loss, corruption or deletion of data. The User is strongly encouraged to regularly download and archive a copy of their content.
The company disclaims any responsibility for third-party services integrated with or used through the platform, which are governed exclusively by their own contractual terms.
In no event shall the company be held liable for damages resulting from misuse of the service or use that does not match its intended purpose.
The user is solely responsible for the content, information, services and activities offered on the site they create via the platform, as well as for compliance with applicable laws and regulations. The company does not warrant the legal compliance of sites created (in particular legal mentions, data protection, cookies, etc.), which is the user's exclusive responsibility.
In any event, the company's liability, from any cause whatsoever, is expressly limited, for professional users, to the total amount actually paid by the user during the twelve (12) months prior.
Where the user qualifies as a consumer, the company's liability cannot be limited or excluded in case of gross negligence, wilful misconduct, or breach of consumer rights as defined by applicable law.
These provisions apply within the limits permitted by applicable law.
These Terms are governed by French law.
In case of a dispute relating to the validity, interpretation, performance or termination of these Terms, the parties shall seek an amicable solution prior to any legal action. Failing an amicable agreement within a reasonable time, any dispute shall be brought before the competent French courts under standard rules.
Where the user qualifies as a consumer, they may use a consumer mediator free of charge, in accordance with the French Consumer Code, to amicably resolve the dispute. The professional accordingly guarantees the consumer effective access to a consumer mediation mechanism.
It is also recalled that the consumer may access the European online dispute resolution platform at the following address: https://consumer-redress.ec.europa.eu/.
In case of a dispute, the competent courts are the French courts. In any case, the consumer may bring the matter before any court territorially competent under the French Code of Civil Procedure, or the court of the place where they resided at the time of conclusion of the contract or of the occurrence of the damaging event.
For professional users, any dispute shall be subject to the exclusive jurisdiction of the courts within the company's registered office, including in case of multiple defendants or third-party guarantee claims.
